02Filing a DMCA Notice

To file a notice of infringement with Loweastore, you must provide a written communication (by email or regular mail) that includes the information specified below.

Important: Please note that you may be liable for damages (including costs and attorney's fees) if you materially misrepresent that material is infringing your copyright(s). If you are not sure whether you are the proper copyright holder or if copyright laws protect the material of concern, we strongly suggest that you first consult a legal professional.

For all email submissions, please include the subject line: "DMCA Takedown Request".

03Required Information

Your DMCA takedown notice must include the following information:

Identification of Copyrighted Work

Identify with sufficient detail the copyrighted work that you believe has been infringed. Please describe the work, and where possible include a copy or the location (URL) of an authorized version of the work.

Identification of Infringing Material

Identify the material that you believe to be infringing and its location on our website. Please describe the material and provide us with the specific URL or any other pertinent information that will allow us to locate the material. Reference specific web pages or posts rather than entire sites.

Your Contact Information

Provide your full name, mailing address, telephone number, and email address so that we may contact you regarding your complaint.

Good Faith Statement

Include the following statement: "I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."

Accuracy Statement

Include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate, and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

Signature

Sign the document with either your physical or electronic signature. An electronic signature (typed full name) is acceptable.

04Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to us. A valid counter-notification must include:

  • Your physical or electronic signature
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the original complainant does not file a court action seeking to restrain the allegedly infringing activity within 10–14 business days, we may restore the removed content.

05Repeat Infringers

Loweastore has adopted a policy of terminating, in appropriate circumstances, accounts or access privileges of users, designers, or content contributors who are deemed to be repeat infringers of the intellectual property rights of others.

We will take appropriate action against any party whose content repeatedly infringes the copyrights of others, which may include:

  • Removal of all infringing content
  • Termination of the user's account
  • Permanent ban from our platform
  • Reporting to appropriate legal authorities
